Befristeter Vertrag"},"content":{"rendered":"<p>Mit der Arbeitsreform d\u00fcrfen befristete Arbeitsverh\u00e4ltnisse aufgrund von Produktionsumst\u00e4nden nur in folgenden F\u00e4llen in Anspruch genommen werden:<\/p>\n<ul>\n<li><strong>Wenn Arbeitsspitzen auftreten, die sich nicht in jeder Saison wiederholen<\/strong>, die nicht strukturell sind und nicht vorhersehbar sind. Beispielsweise k\u00f6nnte ein Unternehmen, das OP-Masken herstellt, aufgrund einer vor\u00fcbergehenden und unvorhersehbaren Nachfragesteigerung einen solchen Vertrag abgeschlossen haben.<\/li>\n<li><strong>F\u00fcr Bedarfe von verk\u00fcrzter Dauer und deren Ende bekannt ist<\/strong> (zB f\u00fcr die Organisation einer Veranstaltung f\u00fcr drei Wochen). <strong>Die H\u00f6chstdauer wird auf 90 Tage im Kalenderjahr verk\u00fcrzt<\/strong>, die nicht durchgehend genutzt werden d\u00fcrfen, und zwar unabh\u00e4ngig von der Anzahl der zur Deckung des jeweiligen Bedarfs erforderlichen Arbeitskr\u00e4fte an jedem dieser Tage. Es ist beispielsweise nicht m\u00f6glich, vom 1. Januar bis 31. M\u00e4rz \u00fcber diese Kategorie eine Arbeitskraft einzustellen, da es sich um durchgehende Tage handelt. Es wird auch nicht m\u00f6glich sein, einen Arbeiter f\u00fcr Januar, einen weiteren f\u00fcr M\u00e4rz, einen weiteren f\u00fcr April und einen weiteren f\u00fcr Oktober einzustellen, da die 90 Tage \u00fcberschritten sind. Auf der anderen Seite k\u00f6nnen f\u00fcnf Arbeiter f\u00fcr den Januar und zehn f\u00fcr die zweite Augusth\u00e4lfte eingestellt werden.<\/li>\n<li>Diese Vertr\u00e4ge k\u00f6nnen auch verwendet werden,<strong> wenn es Schwankungen gibt, die, obwohl es die normale T\u00e4tigkeit des Unternehmens ist, zu einer vor\u00fcbergehenden Diskrepanz zwischen der verf\u00fcgbaren stabilen<\/strong> Besch\u00e4ftigung und der erforderlichen wie im Jahresurlaub). Nat\u00fcrlich kann es nicht dazu verwendet werden, ausscheidende Festangestellte zu ersetzen. Und bei vor\u00fcbergehenden Anstiegen des Aktivit\u00e4tsvolumens, die sich jedoch in jeder Saison wiederholen (z. diskontinuierlich oder Teilzeit unbefristet.<\/li>\n<\/ul>\n<p>Zwischen dem 31. Dezember 2021 und dem 30. M\u00e4rz 2022 abgeschlossene Werk- und Dienstleistungsvertr\u00e4ge unterliegen den vorstehenden Regelungen, d\u00fcrfen jedoch eine Laufzeit von sechs Monaten nicht \u00fcberschreiten. Ab dem 30.
